Exemption

Please be aware that any application that is inactive, meaning no modification or revision to its content requested by the Standards Administrator has been submitted for GNPEC review, for more than 6 months will be removed from the document database, EDvera. Removal constitutes the deletion of all supporting documentation associated with the application. Any future resubmission will be viewed by the Commission as a new application. Any fees paid are not refundable but will be available as a credit.

1. What is exemption?

Exemption means that an institution does not require full authorization.

 

2. What is the difference between exemption and authorization?

 Exemption does not require the full authorization process.  Each category of exemption has its own application or approval process. 

 

3. What types of institutions qualify for exemption?

O.C.G.A. § 20-3-250.3. Educational institutions exempted from application of part lists the exemption categories under which an institution may be eligible.  The exemption must apply to the institution in its entirety for an institution to be considered “exempt”; if only parts of the exemption apply, the institution is not exempt.

 

4. What does the exemption process involve?

The exemption process varies based on the type of exemption under which an institution falls. The applications and process for religious exemption, cosmetology exemption, financial audit-only exemption, and bond-only exemption can be found within the Exemption application documents on www.gnpec.org. 

 

5. What is the cost of applying for exemption?

The cost varies depending on the type of institution you wish to operate.  Please see the Schedule of Fees for reference.

 

6. I wish to open a cosmetology school. What is the process for seeking a Certificate of Compliance through GNPEC?

7. What should I do if changes are made to my institution after I receive the exemption that could potentially affect my status?

 It is imperative that you contact the Commission immediately to ensure that the change does not affect the institution’s exemption and potential compliance with Georgia Law.

 

8. How do I begin the exemption application process?

To inquire about qualification and/or to begin the exemption process, please read O.C.G.A. § 20-3-250.3. Educational institutions exempted from application of part to determine which exemption category applies to your institution, and send a letter to the Commission detailing your institution’s operations and request for exemption.  Upon completion of evaluation, official notification will be returned in writing.

Federal Online Compliance

Federal Online Compliance Information

 
The Commission offered, through and including October 17, 2016, the opportunity for out-of-State entities to gain permission to offer online programming through a process identified as “Federal Online Compliance”. This process had been offered by the Commission since early in 2011 and was structured to assist such entities to respond to the requirements of 34CFR600.9. In excess of 1100 entities nationwide took the opportunity offered by the Commission, and several hundred will remain permitted through and including October 16, 2017, resultant from having pursued and completed this process.

Given that this process is no longer available to be initiated or reinitiated, any entity which desires to provide online programming or an activity in the State which constitutes “physical presence” must either file an application for a Certificate of Authorization or be SARA-approved from their State and conduct such activities within the context of NC-SARA policy. If your state is not a SARA member, the only option which can be provided is filing an application with the Commission. Should you wish to file an application, a telephone interview will be necessary.

According to a Memorandum of Understanding between the Georgia State Board of Cosmetology and the Georgia Nonpublic Postsecondary Education Commission, all Cosmetology schools must file an annual application for a Certificate of Compliance for the first five (5) years of operation, which includes a payment into the Tuition Guaranty Trust Fund (TGTF) and the maintenance of a surety bond obtained through an insurance company.  An original bond with original signatures and seal, along with the NPEC Bond Form are required.  Upon renewal, Bond Continuation Certificates or Riders are acceptable.  (NOTE:  The expiration date for your Certificate of Compliance will be consistent with the date your bond expires.  Your renewal application should be submitted within the month prior to this date.)

Bond Requirements

Bonds indemnify the Georgia Nonpublic Postsecondary Education Commission (GNPEC) in the event that an institution closes without completing the education paid for by students. Bonds are required to be held by every institution for the first 5 years of operation. Additional information can be found here.

Tuition Guaranty Trust Fund (TGTF)

The Georgia Nonpublic Postsecondary Education Commission (GNPEC) has adopted the following schedule of fees for participation in the Tuition Guaranty Trust Fund. This fund was created by an Act of the Georgia General Assembly in its 1990 Session (HB 319, O.C.G.A. ¡± 20-3-250.27, effective July 1, 1990).

  • Each school is responsible for a payment of 1/10 of one percent of gross tuition. This is required annually for the first five years.
  • Minimum annual payment: $100

Religious Exemption

General Information

Nonpublic, nonprofit, postsecondary education institutions which demonstrate annually to the satisfaction of the commission that their purposes are solely to provide programs of study in theology, divinity, religious education, and ministerial training, and that they do not grant postsecondary certificates, diplomas or degrees of a nonreligious nature, may be eligible for this exemption.

An institution applying for this exemption must certify that it accepts no federal or state funds and that it accepts no student who has a federal or state educational loan to attend the institution.

Application for Exemption

Submission of the following will be required for this exemption:

  1. 501 (c)(3) authorization from the IRS
  2. Secretary of State confirmation of nonprofit status and/or nonprofit charter for the institution
  3. Catalog or brochure detailing programs being offered
  4. Sample of diploma, certificate, and/or degree awarded
  5. An online application (Please follow the instructions listed for new or renewing institutions)
  6. Non-refundable Application Fee

Please note that if this is an initial application establishing a new school, you may not use “college” or “university” in naming the institution.
